この本を買った。会社にあったけど第2版が出てたので。

発明とは何かということを考えるときに役立ちそうな気がする。主に米国のやり方をベースとしているけれども、発明という概念自体は米国も欧州もないわけで十分に使えると思う。

イントロによるとPart IからPart IVまであって、

  1. 発明のコンセプト
  2. 請求項を書いてみる
  3. 明細書を書いた後に起こることを予測・対処する
  4. 明細書のストーリー

という感じらしい。見たところひたすらにProblem-Solutionアプローチのようだ。それについて、Robert Goddardのロケットの発明を例として説明している。

基本的なフォーマットは

The problem(s) of ~ is (are) solved by ~.

こういう課題をこういう手段で解決するというのが発明。

The problem of 

enabling a rocket to carry a large amount of combustible material while keeping the weight of the rocket as low as possible

is solved by

successively feeding portions of the material to the rocket’s combustion chamber from a separate casing containing the supply of combustible material.

これを請求項にすると

A rocket apparatus having, in combination,

a combustion chamber,

a casing containing a supply of combustible material, and 

means for successively feeding portions of said material to said combustion chamber.

ロケットの重量をできる限り軽くしながら、最大限の燃料をロケットが運べるようにするにはどうしたらいいかという課題があって、連続的に燃料をチャンバに供給するというのが発明。請求項にすると、チャンバと、燃料タンクと、燃料タンクからチャンバに連続的に燃料を供給する手段とを有するロケットとなる。わかりやすい例だと思う。having, in combinationというのは正直あまり見かけないので、最近のスタイルではないのかもしれない。なんと言っても100年前の発明だ。今だとcomprisingだけで済ましてしまいそう。

初版は2007年でこの第2版が2013年。最近のアメリカの判例を考慮したそうだ。イントロはここまで。

早速Chaper 1。発明というと発明品という具体的なものをイメージされがちだが、実際には抽象概念であって、特定の発明品に限定されるべきではないみたいなことがEmerson StringhamのDouble Patentingという本に書いてあるらしい。

では実際に発明を例にとって見てみましょうということでボールペンの特許が紹介されている。こうやって実際の特許を見てみるのは面白い。

Patent US392046 - op weym - Google Patents

John Loudという人の1888年公開の発明。あまり使い物にならなかったらしく、実際に使われているのは1938年に考案されたものとのこと。

a tube having a contracted mouth and adapted to hold ink,

a spheroidal marking point projecting from the mouth, and

an ink flow regulator that resiliently holds the marking point against the mouth.

今日はここまで読んだ。なかなか面白そうな本である。
